<br />. <br /> <br />" <br /> <br />Agenda Item 26a(6) a <br />Case No. 5-98CW064; The Dunkin Group . <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its July 13-14, 1998, meeting. <br />This is an application for a change of water rights on the Blue River near Breckenridge in Summit <br />County (see attached map). In case no. 5-92CW008, the Applicant obtained approval of a plan for <br />augmentation for the operation of fourteen wells intended to serve the development of up to fourteen <br />single-family lots. Terms and conditions were included that protected the Board's instream flow <br />water rights on the Blue River. The development has since been reduced to ten lots, creating a <br />surplus of augmentation water from the decreased demand. In this application, the Applicant <br />proposes two additional single-family units, one with a caretaker unit and 500 square feet of outside <br />irrigation. Since the well located on the property is an exempt household use only well and cannot <br />be used for irrigation or caretaker units, the Applicant proposes to use the surplus water from case <br />no. 5-92CW008 to augment the entire use from the wel1. <br /> <br />The Board holds the following instream flow decrees which could be injured by this application: <br /> <br />Case No. Stream Amount (cfs) Aooroo. Date <br />5-86CW204 Blue River 20/10 03/14/86 <br />5-86CW217 Blue River 32/16 03/14/86 -- <br />Stioulation <br /> <br />Applicant has agreed to the following terms and conditions which will provide full protection for <br />the Board's instream flow water rights on the Blue River. <br /> <br />. Applicant has agreed to abide by the terms and conditions previously agreed to in case no. <br />5-92CW008, and will incorporate the terms verbatim in the decree sought in this application. <br />These terms and conditions provide sufficient limits on the proposed augmentation plan as <br />to fully protect the Board's rights in this change case.
