The CWCB has agreed that under section <br />37-92-l02(3)(b), C.R.S., its Texas Creek instream flow water right will be subject to certain uses of water by <br />Applicant in existence on the date the Board appropriated its Texas Creek water right, which uses are documented <br />by an affidavit from the Applicant's ranch manager. The Applicant has agreed to the following terms and <br />conditions in its decree: <br /> <br />. Applicant's diversions of water that are not historic practices included in the above-referenced affidavit are <br />junior to the CWCB's Texas Creek instream flow water rights and shall not be made at times that those water <br />rights on Texas Creek are not satisfied and the CWCB is placing a call for those water rights. <br />. The Applicant shall install, maintain, and monitor such measuring devices as may be required by the State <br />and Division Engineers to administer the terms of the decree. <br /> <br />. <br /> <br />. <br />
