By this application, the applicant is seeking a junior conditional storage right <br />to enlarge the existing Fish Creek Reservoir by 200 AF. Applicant previously applied for <br />and received a junior conditional storage right to enlarge the reservoir by 2000 AF. The <br />Board did not oppose that application as the issue of inundation had not yet come before <br />the Board. <br /> <br />The proposed 200 AF enlargement will inundate a combined total of approximately <br />100 feet of Middle Fork Fish Creek and Granite Creek (see attached map). The Board has <br />instream flow water rights on these two streams which may be injured by this proposed <br />reservoir enlargement. <br /> <br />Discussion <br /> <br />The Board staff and the staff of the Division of Wildlife have field-inspected the <br />affected stream reaches. The DOW has evaluated the resource, the stream. habitat and the <br />length of stream to be inundated. The results uf this investigation are included in the <br />attached letter from Jay Skinner. <br /> <br />Stipulation <br /> <br />The attached stipulation, which has been approved by the applicant and <br />recommended by the Attorney General's Office, incorporates the recommendations of the <br />
