6. Name of the stream involved: Beaver Creek.

7. The source of the water is Beaver creek, tributary to
the Cache la Poudre River.

8. Legal description of the stream segment through which
an instream flow is claimed:

The natural stream channel from the outlet of
Comanche Reservoir 1n the NE/4 SW/4 S12, T7N, R74W
6th P.M. as the upstream terminus and extendinq to
the confluence with South Fork Cache la Poudre River
in the NW/4 NE/4 515, T7N, R73W 6th P.M. as the down-
stream terminus, being a distance of approximately
5.7 miles. This segment can be located on the
Comanche Peak and Pingree Park U.S.G.S. quadrangles.

9. Use of the water: For instream flows to preserve the
natural environment to a reasonable degree.

10. Date of appropriation: December 11, 1987. The appro-
priation was initiated and water first put to beneficial use on
December 11, 1987, by action of the Colorado Water Conservation
Board under Sections 37-92-102(3), 37-92-103(3), 37-92-103(4),
and 37-92-103(10), C.R.S.

11. Amount of water granted: 8.0 c.t.s. ABSOLUTE (April 1
through October 31) and 4.0 c.t.s. ABSOLUTE (November 1 through
March 31).

12. Timely and adequate notice of these proceedings has
been given in the manner required by law. The Court has juris-
diction of this application and over all parties affected hereby,
whether they have appeared or not.

DECREE

13. The findinqs of fact and conclusions of law are
incorporated herein by this reference as if set out in full.

14. The application for instream flow vater right, as de-
scribed above, is hereby approved.

15. Historic operations of Comanche Reservoir (as decreed
by the Larimar county District Court on December 18, 1945),
including seepaqe or other releases of water from the Reservoir,
shall not be affected or controlled by this decree.
