Name of the stream involved: Beaver Creek. <br /> <br />7. The source of the water is Beaver creek, tributary to <br />the Cache la Poudre River. <br /> <br />8. Legal description of the stream segment through which <br />an instream flow is claimed: <br /> <br />The natural stream channel from the outlet of <br />Comanche Reservoir 1n the NE/4 SW/4 S12, T7N, R74W <br />6th P.M. as the upstream terminus and extendinq to <br />the confluence with South Fork Cache la Poudre River <br />in the NW/4 NE/4 515, T7N, R73W 6th P.M. as the down- <br />stream terminus, being a distance of approximately <br />5.7 miles. This segment can be located on the <br />Comanche Peak and Pingree Park U.S.G.S. quadrangles. <br /> <br />9. Use of the water: For instream flows to preserve the <br />natural environment to a reasonable degree. <br /> <br />10. Date of appropriation: December 11, 1987. The appro- <br />priation was initiated and water first put to beneficial use on <br />December 11, 1987, by action of the Colorado Water Conservation <br />Board under Sections 37-92-102(3), 37-92-103(3), 37-92-103(4), <br />and 37-92-103(10), C.R.S. <br /> <br />11. Amount of water granted: 8.0 c.t.s. ABSOLUTE (April 1 <br />through October 31) and 4.0 c.t.s. ABSOLUTE (November 1 through <br />March 31). <br /> <br />12. Timely and adequate notice of these proceedings has <br />been given in the manner required by law. The Court has juris- <br />diction of this application and over all parties affected hereby, <br />whether they have appeared or not. <br /> <br />DECREE <br /> <br />13. The findinqs of fact and conclusions of law are <br />incorporated herein by this reference as if set out in full. <br /> <br />14. The application for instream flow vater right, as de- <br />scribed above, is hereby approved. <br /> <br />15. Historic operations of Comanche Reservoir (as decreed <br />by the Larimar county District Court on December 18, 1945), <br />including seepaqe or other releases of water from the Reservoir, <br />shall not be affected or controlled by this decree. <br /> <br />-2- <br />
