This appropriation extends from the <br />outlet of Comanche Reservoir to the confluence with the South Fork Cache La Poudre <br />River in Larimer County (see attached map). The Board's appropriation is for 8 cis for the <br />period April 1 through October 31, and 4 cis for the period November 1 through March 31. <br /> <br />The City of Greeley filed a statement of opposition to the Board's application for <br />instream flow water rights expressing concern that the Board's right may in some way affect <br />or control operation of Comanche Reservoir. <br /> <br />Proposed Stipulation <br /> <br />Attached is a consent decree which has been prepared by the Attorney General's <br />staff and accepted by Greeley. Paragraph 15 of the proposed decree provides that "Historic <br />operations of Comanche Reservoir (as decreed by the Larimer County District Court on <br />December 18, 1945), including seepage or other releases of water from the Reservoir, shall <br />not be affected or controlled by this decree." <br /> <br />Staff Recommendation <br /> <br />The staff recommends that the Board ratify the proposed settlement with the City of <br />Greeley. <br /> <br />DCM/JB/bj <br />Attachments <br /> <br />187CW267.SfP <br />
