Instream Flow Program: Stipulations
Case No. 1-90CWI93; Boulder Creek

Case Summary

In November, 1990, the Board approved a donation agreement with the City of
Boulder which provided for the use of the City's senior water rights by the Board to
maintain instream flows in Boulder Creek (see attached map). In December, 1990, the
Board and the City filed a joint application with the water court to change the use of the
City's rights to include the use by the Board for instream flow purposes. The application
was opposed by several entities including the Boulder & White Rock Ditch & Reservoir
Company.

Proposed Stipulation

The City of Boulder has taken the lead in prosecuting this change case in water court
and has been working with objectors to resolve concerns. The attached stipulation with The
Boulder & White Rock Ditch & Reservoir Co., which has been signed by the objector and
the City of Boulder and has been approved by the staff of the Attorney General's Office,
recognizes the objector's decreed senior rights for Panama Reservoir No. 1.

Staff Recommendation

The staff recommends that the Board ratify the attached stipulation with The Boulder
& White Rock Ditch & Reservoir Co.
