P.E. <br />Division DirectOr <br /> <br />DATE: October 23, 1992 <br /> <br />SUBJECf: Agenda Item 12a, November 9-10, 1992, Board Meeting-- <br />Instream Flow Program: Statements of Opposition <br />Case No. 1-92CW079; City of Louisville <br /> <br />Application Summary <br /> <br />This is an application for a change of water rights on South Boulder Creek near <br />Eldorado Springs in Boulder County (see attached map). Applicant seeks to change the <br />type of use, place of use, time of use and points of diversion of its share of senior water <br />rights in the Marshall Lake Division of the Farmers Reservoir and Irrigation Company and <br />the South Boulder and Coal Creek Ditch Company. Applicant's water rights are currently <br />diverted out of South Boulder Creek through the Community Ditch and the South Boulder <br />and Coal Creek Ditch. Additional water rights are diverted out of Clear Creek through the <br />Church Ditch. Applicant proposes alternate points of diversion for its water rights through <br />the City of Louisville Pipeline and the Coal Creek Golf Course Pipelines. Furthermore, <br />applicant intends to divert its rights to various alternate points of storage within the Coal <br />Creek drainage basin. The water rights will be changed from direct flow irrigation rights to <br />year-round storage and municipal rights. <br /> <br />CWCB Appropriation <br /> <br />The Board holds an instream flow decree on South Boulder Creek for 15 cfs during <br />the summer, and 2 cfs during the winter with an appropriation date of December 2, 1980, <br />which could be injured by this application. <br /> <br />Potential for Injury <br /> <br />The applicant's proposed change in use of its water rights may injure the Board's <br />instream flow water rights by expanding the amount and/or timing of diversions from South <br />Boulder Creek. <br />
