Comments on draft preliminary San Juan River Flow Recommendation
July 8, 1998
Page 5 of5

Conclusion

We believe these questions need to be addressed along with the completed technical
reports before any further action on the recommendations is taken. Furthermore, we
believe that the public should have adequate opportunity to review and comment on the
recommendations, and there use and enforcement while the recommendations are still in .
a preliminary form and prior to any action to adopt the recommendations by either the
Biology or Coordination Committees.

We have been directed by the Colorado Water Conservation Board to oppose any action
by the San Juan Recovery Implementation Program that would formally adopt the flow
recommendations, even in draft form, until a public review of the recommendations has
been completed. Such public review must include:

. the technical reports supporting the recommendations; and
. an agreement on procedures for Section 7 consultations that includes direction
on the implementation, use and enforcement of the recommendations and the
role of the Recovery Program in providing the reasonable and prudent
altemative.

We appreciate the work that has been accomplished by the Committees and look
forward to working with the Committees to resolve the issues identified above.

Cc:
Colorado Water Conservation Board
Colorado Endangered Fish Team

C:\mydocuments\sjripflowreccom.598
