The motion was seconded by Don Schwindt and approved unanimously <br />(10-0). <br /> <br />23. Stream and Lake Protection Section - Amendments to 2004 New Appropriations <br />Tape 2, Track 3 00:00 - 06:44 <br />Action: A motion was made by Eric Wilkinson to accept the staff recommendation that <br />the Board determine that the natural environment will be preserved to a <br />reasonable degree by the water available for the recommended appropriations, <br />and direct staff to authorize the Attorney General's Office to submit the proposed <br />rulings to the water court that include the revised flow amounts and time periods <br />for Potter, Roubideau and Spring Creeks. The motion was seconded by John <br />Redifer and approved unanimously (10-0). <br /> <br />24. Stream and Lake Protection Section - ISF Subcommittee <br />Tape 2, Track 3 45:22 - 48:31 <br />Action: Informational item; no action taken. <br /> <br />25. Stream and Lake Protection Section - Adoption of Strategic Plan <br />Tape 2, Track 3 33:52 - 45:22 <br />Action: A motion was made by Don Schwindt that the Board adopt the Strategic Plan for <br />the Stream and Lake Protection Section as presented. The motion was seconded <br />by Bob Burr and approved (9-1). Tom Sharp voted Nay. <br /> <br />26. Stream and Lake Protection Section - Injury with Mitigation - Case No 5-03CW331 <br />Tape 2, Track 3 06:44 - 21:44 <br />Action: A motion was made by Eric Wilkinson that the Board approve the staff <br />recommendation and 1) Make a final determination that the natural environment <br />of Rock Creek can be preserved to a reasonable degree with the proposed injury <br />or interference to the Board's Rock Creek ISF water right with the mitigation that <br />the Applicant has committed to provide, and 2) Ratify this pretrial resolution and <br />authorize Staff and the Attorney General's Office to enter into the proposed <br />stipulation, which will require the entry of a decree that contains the injury with <br />mitigation provisions, including the flow-sharing agreement, and including the <br />modified language in paragraph 10 that was discussed during this item. The <br />motion was seconded by Harold Miskel and approved unanimously (9-0). Tom <br />Sharp recused himself from this item. <br /> <br />27. Stream and Lake Protection Section - Pre- Trial Resolution - Case No 3-04CW041 <br />Tape 2, Track 3 21:44 - 33:52 <br />Action: A motion was made by Bob Burr to accept the staff recommendation to authorize <br />Staff and the Attorney General's Office to enter into a stipulation with the San <br />Luis Valley Water Conservancy District for the entry of a decree no less <br />restrictive than the one attached in the memo.
