<br />include the language identified in the Spring Creek Special Interest Area, <br />in the GMUG Forest Management Plan; <br />4. Authorize the Staff of the CWCB and the Attorney General to sign the <br />stipulation attached to the Board memo; and, <br />5. Authorize the Staff of the CWCB and the Attorney General to enter into <br />a settlement of the Board's appropriation on Spring Creek, in a manner <br />described in Agenda Item No. 33. <br />These actions are to be conditional upon consultation with the involved parties. <br />The motion was seconded by Don Schwindt and approved unanimously (10-0). <br /> <br />33. Stream and Lake Protection Section - Spring Creek Instream Flow Appropriation <br />Tape 2, Track 5 12:13 - 18:07 <br />Action: A motion was made by Keith Catlin to accept the staff recommendation that the <br />Board <br />1. <br /> <br />2. <br /> <br />Take final action on the original reach of Spring Creek extending from <br />the Spring Outlet down to the Downing Ditch in the following amounts: <br />2.7 cfs (April IS-August 14); 0.8 cfs (August IS-October 14); and 0.5 <br />cfs (October IS-April 14) with a January 23, 2002 appropriation date. <br />Appropriate and take final action on the reach of Spring Creek described <br />above in the additional amounts of 1.9 cfs (August IS-October 14) and <br />2.2 cfs (October IS-April 14) with an appropriation date of May 25, <br />2005. <br />Appropriate an ISF water right for all unappropriated water from natural <br />springs and seeps at the headwaters of Spring Creek down to the spring <br />outlet, with an appropriation date of May 25, 2005. <br />Determine, pursuant to section 37-92-102(3), CRS, and based upon the <br />recommendations of the CDOW, BLM and/or USFS, a review of the <br />data and other information presented by Staff, in this memo and orally, <br />and Staff s recommendation for instream flow appropriations on the <br />streams identified; that: <br />(a) A natural environment does exist on each stream; <br />(b) Water is available in each stream and lake for appropriation; <br />(c) The natural environment will be preserved to a reasonable degree <br />by the water available for the recommended appropriations; <br />(d) There is a natural environment that can be preserved to a <br />reasonable degree with the recommended water rights, if granted; and <br />(e) Such natural environment can exist without material injury to water <br />rights. <br />Direct Staff to file this water right application with the Water Court. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />The motion was seconded by Bob Burr and approved unanimously (10-0). <br /> <br />34a-g.
