1 CONSIDER WHETHER THE PROPOSAL IS IN SUBSTANTIAL COMPLIANCE WITH

2 THE MUNICIP ALITY's PLAN AS PROVIDED BY SECTION 31-12-105 (1) (e) (I),

3 C.R.S., AND OFFER COMMENTS REGARDING THE SERVICE PLAN TO THE

4 BOARD OF COUNTY COMMISSIONERS OF EACH COUNTY WHERE THE SPECIAL

5 DISTRICT IS LOCATED. With reference to the review of any service plan FOR

6 A SPECIAL DISTRICT THAT IS PROPOSED TO BE ORGANIZED WHOLLY OR

7 PARTLY WITHIN A MUNICIPALITY, the governing body of each municipality

8 has the following authority:

9 SECTION 17. 32-1-205 (1), Colorado Revised Statutes, IS

10 amended to read:

11 32-1-205. Resolution ofapproval required. (1) A petition for the

12 organization of a special district filed in any district court of competent

13 jurisdiction pursuant to the provisions of section 32-1-301 shall be

14 accompanied by a resolution approving the service plan of the proposed

15 special district by the board of county commissioners of each county where

16 the territory of the proposed special district lies or, where required

17 pursuant to section 32-1-204.5, by a resolution of approval by the

18 governing body of each municipality, IF THE BOUNDARIES OF A PROPOSED

19 SPECIAL DISTRICT INCLUDE ANY TERRITORY WITHIN A MUNICIPALITY, THEN

20 THE PETITION FOR ORGANIZATION SHALL INCLUDE A RESOLUTION

21 APPROVING THE SERVICE PLAN FROM BOTH THE COUNTY AND THE

22 MUNICIPALITY, If the boundaries of a proposed special district include

23 territory within two or more counties, a resolution approving the service

24 plan for such special district shall be required from the board of county

25 commissioners of each county which has territory included in the proposed

26 special district; but the board of county commissioners of each of the
