<br />e <br /> <br />e <br /> <br />1 CONSIDER WHETHER THE PROPOSAL IS IN SUBSTANTIAL COMPLIANCE WITH <br /> <br />2 THE MUNICIP ALITY's PLAN AS PROVIDED BY SECTION 31-12-105 (1) (e) (I), <br /> <br /> <br />3 C.R.S., AND OFFER COMMENTS REGARDING THE SERVICE PLAN TO THE <br /> <br />4 BOARD OF COUNTY COMMISSIONERS OF EACH COUNTY WHERE THE SPECIAL <br /> <br /> <br />5 DISTRICT IS LOCATED. With reference to the review of any service plan FOR <br /> <br />6 A SPECIAL DISTRICT THAT IS PROPOSED TO BE ORGANIZED WHOLLY OR <br /> <br /> <br />7 PARTLY WITHIN A MUNICIPALITY, the governing body of each municipality <br /> <br />8 has the following authority: <br /> <br />9 SECTION 17. 32-1-205 (1), Colorado Revised Statutes, IS <br /> <br /> <br />10 amended to read: <br /> <br />11 32-1-205. Resolution ofapproval required. (1) A petition for the <br /> <br /> <br />12 organization of a special district filed in any district court of competent <br /> <br />13 jurisdiction pursuant to the provisions of section 32-1-301 shall be <br /> <br /> <br />14 accompanied by a resolution approving the service plan of the proposed <br /> <br /> <br />15 special district by the board of county commissioners of each county where <br /> <br /> <br />16 the territory of the proposed special district lies or, where required <br /> <br /> <br />17 pursuant to section 32-1-204.5, by a resolution of approval by the <br /> <br />18 governing body of each municipality, IF THE BOUNDARIES OF A PROPOSED <br /> <br />19 SPECIAL DISTRICT INCLUDE ANY TERRITORY WITHIN A MUNICIPALITY, THEN <br /> <br /> <br />20 THE PETITION FOR ORGANIZATION SHALL INCLUDE A RESOLUTION <br /> <br />21 APPROVING THE SERVICE PLAN FROM BOTH THE COUNTY AND THE <br /> <br /> <br />22 MUNICIPALITY, If the boundaries of a proposed special district include <br /> <br /> <br />23 territory within two or more counties, a resolution approving the service <br /> <br /> <br />24 plan for such special district shall be required from the board of county <br /> <br /> <br />25 commissioners of each county which has territory included in the proposed <br /> <br /> <br />26 special district; but the board of county commissioners of each of the <br /> <br />e <br /> <br />Reengrossed 1223 <br /> <br />-30- <br />
