<br />e <br /> <br />e <br /> <br />I municipal boundary more than three miles in any direction from any point <br /> <br />2 of such municipal boundary in anyone year, Within said three-mile area, <br /> <br />3 the contiguity required by section 31-12-104 (I) (a) may be achieved by <br /> <br /> <br />4 annexing a platted street or alley, a public or private right-of-way, a public <br /> <br /> <br />5 or private transportation right -of-way or area, or a lake, reservoir, stream, <br /> <br />6 or other natural or artificial waterway, Prior to completion of any <br /> <br />7 annexation within the th,ree-mile area, the municipality shall have in place <br /> <br />8 a plan for that area which THAT IDENTIFIES ANY TERRITORY WITHIN SAID <br /> <br /> <br />9 AREA FOR WHICH THE MUNICIPALITY MAY BE WILLING TO ENTERTAIN AN <br /> <br /> <br />10 ANNEXATION PETITION, SUCH PLAN SHALL generally d';'lj~d DESCRIBE <br /> <br /> <br />II the proposed location, character, and extent of streets, subways, bridges, <br /> <br /> <br />12 waterways, waterfronts, parkways, playgrounds, squares, parks, aviation <br /> <br />13 fields, other public ways, grounds, open spaces, public utilities, and <br /> <br />14 terminals for water, light, sanitation, transportation, and power to be <br /> <br /> <br />15 provided by the municipality and the proposed land uses for the area. <br /> <br /> <br />16 SUCH PLAN SHALL, TO THE EXTENT REASONABLY PRACTICABLE, STATE THE <br /> <br />17 INTENTOFTHEMUNICIP ALITYTO EXCLUDE ANY PROP~RTYwITHINTHEAREA <br /> <br />18 FROM A SPECIAL DISTRICT PURSUANT TO SECTION 32-1-502, C,R.S., <br /> <br /> <br />19 INCLUDING THE MUNICIPALITY'S ASSESSMENT OF THE IMPACTS UPON THE <br /> <br /> <br />20 SPECIAL DISTRICT ARISING OUT OF MUNIClP AL ANNEXATIONS WITHIN SUCH <br /> <br /> <br />21 AREA, Such plan shall be updated at least once annually. Such three-mile <br /> <br /> <br />22 limit may be exceeded if such limit would have the effect of dividing a <br /> <br /> <br />23 parcel of property held in identical ownership if at least fifty percent of the <br /> <br /> <br />24 property is within the three-mile limit. In such event, the entire property <br /> <br /> <br />25 held in identical ownership may be annexed in anyone year without regard <br /> <br />26 to such mileage limitation, Such three-mile limit may also be exceeded for <br /> <br />e <br /> <br />Reengrossed 1223 <br /> <br />-26- <br />
