4. Pueblo RICD

Pueblo amI the CWCS and State and Division Engineers have reached (but not yet signed) a
settlement in the RICO case. The stipulation settles the primary issue which was Pueblo's claim
for nighttime flows. Pueblo agreed to delete that portion of its application in exchange for some
minor terms, including that the State will not oppose its diligence filing on the basis of the
section 37-92-102(6)(a) factors.
