The PBO should clearly state that annual modifications of the RIPRAP made as part <br />of the Recovery Program review process will not be cause to reinitiate consultation. <br />4. A process for tracking the new depletions allowed under the PBO will need to be <br />developed. George Smith and I have agreed to develop a document for further review <br />and discussion by the group. However, closure on a process could take some time. <br />5. Lastly, the PBO refers to recovery goals in a few places. I hesitate to suggest this, but <br />this may be an opportunity to further define what those recovery goals are. <br /> <br />e <br /> <br />10.825 acre-foot Commitment <br />Introduction <br /> <br />One of the Recovery actions required in the PBO is a commitment from water users to <br />provide a firm source of 10,825 acre-feet of water. The purpose of this 10,825 acre-feet <br />is reduce the reliance on the unsold regulatory capacity of Ruedi Reservoir (21,650 acre- <br />feet) by one-half. Reclamation cannot guarantee the hydrology of Ruedi Reservoir. <br />There is a very small but finite risk that in any given year 21,650 acre-feet of water in <br />Ruedi Reservoir may not be available. There are also concems about impacts to <br />recreation on the Fryingpan River if the full 21,650 acre-feet of Ruedi water has to be <br />released in a particular year. <br /> <br />Discussion <br /> <br />Attached is a draft agreement between the Colorado River Water Conservation District e <br />and Denver Water to provide the 10,825 acre-feet over the next 10-years until a more <br />permanent agreement can be put in place. One of the potential requirements of the <br />agreement is a contract with the Colorado Water Conservation Board to deliver this <br />10,825 acre-feet to the IS-mile reach for endangered fish flow augmentation purposes. <br />Such a contract would be similar to the contracts currently in place for the delivery of <br />Ruedi water and Wolford Mountain water to the IS-mile reach. This agreement would <br />need to be in-place by the January 151 following the issuance of a final PBO acceptable to <br />parties. If such an agreement is to be in-place.. work on such an agreement should begin <br />fairly soon. <br /> <br />Recommendation <br /> <br />The Board directs staff to prepare a draft agreement for consideration by the respective <br />parties on the assumption that the PBO appears to be headed in an acceptable directionand is likely to be completed within the year. <br /> <br />Attachment <br /> <br />e <br />
