Beardsley Application Summarv This is an application for a storage right, change of water rights, and approval of a plan for augmentation, including appropriative right of exchange near Green Mountain Reservoir in Summit County. Applicants seek an absolute (1.5 at) and a conditional (1.5 at) storage right for Beardsley Pond No. 1 for irrigation, stock watering, fire fighting, fish and wildlife, recreation and aesthetic uses. Applicants propose to change a portion of their interests in the Sarah Ditch (I cfs) and Sperry Ditch (I cfs), water rights to storage, augmentation, and exchange. Applicants seek approval of a plan for augmentation, using a combination of irrigation historical consumptive use credits and water stored in the Beardsley Pond NO.1 to offset out-of-priority depletions. Applicants also seek a conditional exchange right for a maximum rate of 30 gpm (0.07 cfs), up to 10 af per year with a priority date of 12/1/2005, from the confluence of Brush Creek and South Brush Creek up to the Beardsley Pond No.1. The Applicants' proposed plan for augmentation and exchange may injure the Board's instream flow water rights on South Brush Creek and Brush Creek by not replacing depletions in time, place and amount. Other Obiectors Colorado Springs Utilities and the City and County of Denver, acting by and through its Board of Water Commissioners, also filed statements of opposition to this application.
