<br />. <br /> <br />. <br /> <br />. <br /> <br />Consent Agenda Item la <br />Case No. I-OOCWI48; Falcon Wing Ranch <br /> <br />Application Sununary <br />This is an application for conditional ground water rights and a plan for augmentation. The <br />Applicant seeks to divert water through a number of wells for a subdivision in unincorporated <br />Jefferson County. (See attached map). The Applicant seeks to augment the depletions from these <br />wells with releases from Cold Springs Reservoir and from dryup credits associated with the <br />Hodgson Ditch. To the extent that this matter constitutes a change of water rights, the Applicant <br />seeks such a change. <br /> <br />CWCB Appropriations <br />The Board has appropriated the following instream flow water rights that could be affected by this <br />application: <br /> <br />Case No. <br />94CW260 <br /> <br />Stream <br />Bear Creek <br /> <br />Appro1;Jriation Date <br />9/12/94 <br /> <br />Amount <br />15/7 <br /> <br />Potential for Iniury <br />The Applicant's proposed change of water rights may injure the CWCB' s water rights by depleting <br />Bear Creek upstream from where those depletions have historically occurred. In addition, the <br />Applicant's proposed augmentation sources may not replace the depletions to the Board's instream <br />flow water rights in the same time, place and amount at which those depletions occur. Moreover, <br />no expansion of use may occur from the change of water rights. <br /> <br />Other Objectors <br />Other objectors in this case include: the City of Englewood, the City of Thornton, the Buffalo Park <br />Development Co., the Mountain Mutual Reservoir Co., and the Brook Forest Water District. <br /> <br />L:\Section Folders\SECC\Case Files\2001 \1 OOCW148_mem.doc <br />
