<br />Implementation Recommendations: <br /> <br />SB 02-68 -- No action needed. Members can begin including a request for $50 per diem payments on <br />their travel reimbursement forms as a miscellaneous expense in July 2002. Payments will be made from <br />the Construction Fund. <br /> <br />SB 02-87 - No action needed at this time. No funding will be available until taxes are collected in 2003. <br />Funds ($100,000) are available on July 1, 2002 to administer the program. The Board must appoint two <br />members to work with representatives from the Water Quality Control Commission regarding the <br />awarding of grants. We will develop proposed guidelines and criteria for the awarding of grants in <br />cooperation with the Commission and the Colorado Watershed Assembly for adoption by April 2003. <br />We intend to meet with representatives of these organizations before the July meeting and will update <br />you at that time. <br /> <br />SB 02-156 - No action needed at this time. The bill allows the Board to acquire water rights to "preserve <br />or improve" the natural environment. Staff will review the current Instream Flow Rules and will <br />recommend any necessary changes to the Board at a future meeting. A copy of House sponsor's, Rep. <br />Matt Smith, statement about the bill is attached for your information. <br /> <br />HB 02-1024 - No action needed. Creates a permanent water committee. <br /> <br />HB 02-1152 - No action needed at this time. In addition to writing and executing loan contracts, <br />purchase orders and documents to provide non-reimbursable funds, several sections of the Projects Bill <br />require Board action for implementation. <br /> <br />. Section 20 (Small Project Loans). The Board is now authorized to loan up to $1 million without <br />General Assembly approval. The Board must submit a written determination of the basis for such <br />loans by January 15 ofthe following year. <br /> <br />. Section 25 (Water Education Foundation). The Foundation is supposed to promote a better <br />understanding of water issues through educational opportunities and resources so Colorado citizens <br />will understand water as a limited resource and will make informed decisions. A steering committee <br />formed to develop articles of incorporation and bylaws has met. We will bring you these documents <br />to review in July 2002. You will also be responsible for reviewing the purposes of the Foundation <br />annually and may cease providing funds if you determine the Foundation is not performing its <br />function. You may also set terms and conditions conceming the annual expenditure of moneys. <br /> <br />. Section 28 (Fish and Wildlife Resources Mitigation). The statute now recognizes the role instream <br />flows and river restoration proj ects play in mitigating the effects of construction, operation and <br />maintenance of water projects. Your Staff and operators of existing water projects may now apply <br />directly to you for funds for mitigation activities. These funds will be available in July. Therefore, <br />we intend to develop policies, guidelines and criteria for a grant program to implement this section <br />for you to review in July 2002. <br /> <br />. Section 29 (Contracts, Charges and Donations). The Board may now charge any entity receiving <br />funds from the Board. These charges may be used to supplement the Board's operating budget. We <br />intend to work with you to determine when and if to use this authority. Section 29 also clarifies that <br />we may receive and expend donations from any source to carry out our mission. <br /> <br />HB 02-1041 - No action needed. The bill should help us ensure that the funding available from the <br />Operational Account of the Severance Tax Trust Fund Operational Account is not further diminished. <br /> <br />HB 02-1352 - No action needed. We no longer have to send a copy of every report we produce to every <br />member of the General Assembly nor do we have to report to the General Assembly about litigation that <br />involves the use of money from the Litigation Fund. <br />Colorado Water Conservation Board 2 <br />Flood Protection.
