<br />. <br /> <br />Consent Agenda Item lob <br />Case No, 1-05CW316; City and County of Denver, <br />acting by and tlu'ough its Board of Water Commissioners <br /> <br />Application Summary <br /> <br />This is an application for a water storage light and for confinnation that the telm "municipal use" as <br />used in the decrees in Case Nos. 80CW406 and 87CWl16 includes the right to store and release <br />water diverted under those priolities to fulfill federal pem1it conditions of the Applicant's Foothills <br />Project. Applicant seeks an absolute water storage right in Strontia Springs Reservoir for the <br />Waterton Canyon Water Management Plan. Uses are to satisfy and fulfill the requirements of the <br />Waterton Canyon Water Management Plan, including storage and piscatolial uses, to provide <br />specific average daily flows for certain months in the South Platte River from Strontia Springs Dam <br />to Chatfield Reservoir. The claimed appropriation date is August 16, 1978 and the amount claimed <br />is 7,864 acre-feet. <br /> <br />CWCB Appropriations <br /> <br />The CWCB does not hold an instream flow water right on the specified rcach of the South Platte <br />River. <br /> <br />. Potential for Iniury <br /> <br />The Applicant's claimed use of the requested water light to "provide average daily flows of 60 cfs <br />from May 15 to September 15 and average daily flows ono cfs from September 16 to May 14 from <br />Strontia Springs Dam to Chatfield Reservoir" may conflict with the Board's exclusive authOlity to <br />appropliate instream flow and natural lake level water lights, Section 37-92-102(3) CR,S, provides: <br />".. .no other person or entity [other than the CWCB] shall be granted a decree adjudicating a right to <br />water or interests in water for instream flows in a stream channel between specific points, . ' , for any <br />purpose whatsoever." <br /> <br />The January 2006 Director's report contained a detailed bliefing on this pending application, <br /> <br />Other Obiectors <br /> <br />The Burlington Ditch, Reservoir and Land Company, Parker Water and Sanitation District, <br />Centelmial Water and Sanitation District, and City of Aurora, acting by and through its Utility <br />Enterprise, also filed statements of opposition to this application, <br /> <br />. <br />
