MR. KELLY:
MR. MOSES:

J

MR. McCANDLESS:

MR. MOSES:

MR. WILLIAMS:

MR. MOSES:

'I MR. McCANDLESS,

MR. MOSES:

466

- 11 -

"That figure is not in the Compact?"

"It is stated what the release for storage
would be. But again we would say we think
that it should be based on whether there is
that much in the Basin to begin with. It
doesn't make any difference in our debit, but
does in Texas credit, and we do not want '
to get ourselves in a position where they are
entitled to 790,000 acre feet regardless." .

"Colorado agreed to an allocation of so
many acre feet regardless of the amount of
water we receive in snowfall?"

"It is not a given amount. It is on a
curve which takes into consideration a
low water year. Let's put it this way.
A normal for about a fifty-year average would
amount in the Rio Grande to 600,000 acre
feet. When 600,000 acre feet comes into the
valley we would have to let, say, 200,000
acre feet go out. If we only have 300,000
or 400,000 acre feet, we would have to deliver,
say, 125,000 acre feet. Then if it comes
to a point on the curve, if it should ever
happen, that more than 1,100,000 acre feet should
pass Del Norte in anyone year, we would have
to deliver 10~o of the water above that amount.
It is on a curve and we have a table by which
it is computed. It isn't 200,000 acre feet
a year regardless, and it isn't a straight
percent. "

"If a debit is established, Colorado will
have to make it up?-

"When that is established, Colorado will
have to make it up when in default over 100,000
acre feet. These debits and credits go back
and forth from year to year, but the compact
is so worded that Colorado is allowed that
amount.- ,

"Then we may have to shut, off in order to
deliver?"

"I don't ,think they would ever shut us off
10~o. It is quite possible they will put
a federal official on the stream to see that
