<br />~, <br /> <br />. <br /> <br />Consistent with Section 8 of the Act ofJ\UJ.e 17, 1902 (32 Stat. 388) the Secretary and all <br />persons or agencies or entities, private or public, which contract with the Secretary for the use of <br />excess capacity in Reclamation project facilities to store or convey non-project wqter must <br />comply with all applicable. state laws, including, but not limited to, those concerning the <br />appropriation, diversion, storage, and use ofwatet, area of origin protections, and changes of <br />water rights. Nothing in this section shall be construed to provide the Secretary a basis to <br />compel the enactment of state legislation. <br /> <br />Section 206. Applicability. <br /> <br />The provisions ofthis title shall not: <br /> <br />(a) be applicable to Closed Basin Division of the San Luis Valley Project in Colorado. <br /> <br />(b) supercede project-specific authority to contract for the use ofproject facilities. <br /> <br />\6_4521120816.v6 <br /> <br />7 <br />
