<br />March 7, 2000 version <br /> <br />A 8ILL <br />TO AUTHORIZE THE SECRETARY OF THE INTERIOR TO ENTER INTO <br />CONTRACTS FOR THE USE OF EXCESS CAPACITY IN BUREAU OF <br />RECLAMATION FACILITIES, AND FOR OTHER PURPOSES <br /> <br />Be it enacted by the Senate and House of Representatives of the United States of America in <br />Congress assembled That: <br /> <br />Section 1. Short Title. <br /> <br />This Act may be cited as the "Reclamation Projects Excess Facilities Capacity Act." <br /> <br />Section 2. Contracting Authorities. <br /> <br />Section 9 of the Act of August 4,1939 (43 U.S.C. ~485h), is amended by inserting a new <br />subsection (f) and relettering the succeeding subsections of 43 U.S.C. ~485h accordingly, the <br />new subsection (f) to read: <br /> <br />"(f) the Secretary may utilize the contracting authorities provided by subsection (c), (d). <br />and (e) of this section to furnish water from any project, or unit or division of a project, <br />constructed or acquired by the Secretary pursuant to Reclamation law, including the Act of <br />June 17, 1902 (32 Stat. 388), and acts amendatory thereof and supplementary thereto, whether a <br />project, or unit or division thereof, was authorized and constructed or acquired before, on, or <br />after August 4, 1939." <br /> <br />Section 3, Definitions. <br /> <br />As used in this Act: <br /> <br />(1) The term "project contractor" shaH mean any person or entity which has a contract <br />with the United States, acting through the Secretary of the Interior, that provides for the use of <br />project water by such person or entity. <br /> <br />(2) The term "ineligible land" shaH meaI1 any land which is not entitled, or otherwise <br />eligible, to receive project water: (i) by virtue of the requirements and conditions set forth in the <br />Act of June 17, 1902 (32 Stat. 388), and acts amendatory thereof and supplementary thereto, in <br />the Water Conservation and Utilization Act, which shaH mean both the Act of August II, 1939 <br />(16 U.S.C. ~~590y - 590z-10) and the authority contained in the Interior Department <br />Appropriation Act, 1940 (53 Stat. 719), in any regulations implementing those acts, or in any <br />contract between the Secretary and a project contractor, or (ii) by virtue of any determination <br />made by the Secretary pursuant to such acts. regulations, or contracts. <br />
