Nine voting members were present at <br />the call to order so a quorum was present (at least six required), Voting Board members present <br />were Chair Barbara Biggs, Vice Chair John Redifer, Executive Director, Department of Natural <br />Resources, Russell George, Keith Catlin, Don Schwindt, Bob BUlT, Tom Sharp, Eric Wilkinson, <br />and Travis Smith. Ex Officio members present or represented were CWCB Director Rod <br />Kuharich, Acting CWCB Deputy Director Rick Brown, State Engineer Hal Simpson, State <br />Agricultural Commissioner Don Ament, and Deputy Attorney Gcneral Casey Shpall for Attorney <br />General John Suthers. <br /> <br />15. Stream and Lake Protection Section - Horsefly Creek - Motion to Intervene and Notice <br />to Contest <br />Tape 2, Track 2 00:05:21- 00:58:45 <br />Action: A motion was made by Don Schwindt, and seconded by John Redifer to approve <br />Staff's recommendation that the Board 1) deny Pacific/Desert's request to <br />intervene; 2) direct staff to work with Pacific/Desert to address its concerns and <br />develop mutually acceptable terms and conditions to include in the Horsefly <br />Creek instream flow decree; and 3) take final action on the Horsefly Creek <br />instream flow appropriation as will be requested in Agenda Item 18b and file a <br /> <br />Flood Protection.
