Report from Executive Session <br />Tape 2, Track 1 05:46 - 14:00 <br />Action: 12a,d,e - Information items; no formal action taken. <br />Action: 12g. A motion was made by Ray Wright and seconded by Greg Hoskin to direct <br />the Attorney General's office to take action on Agenda item 12.g. Animas-La <br />Plata Project Application, Case No. 7-01CW54. The motion was approved 8- <br />O. Carolyn McIntosh and Greg Walcher were not present. <br /> <br />Action:12h. A motion was made by Greg Hoskin and seconded by Don Schwindt to <br />recommend that the Attorney General's office defer action on Agenda item <br />l2.h. Errata for the Arapahoe/Roosevelt Forest Plan. The motion was <br />approved 8-0. Carolyn McIntosh and Greg Walcher were not present. <br /> <br />14. Stream and Lake Protection - 2003 Gunnison River New Appropriation <br />Recommendation - Water Division 4 Montrose, Delta and Mesa Counties. <br />Tape 2, Track 1 14:00 - 2:25:00 <br />Action: A motion was made by Greg Hoskin and seconded by Ray Wright to approve <br />the staff recommendation that the Board modify the schedule set forth in Rule <br />5.20, to the schedule set forth in the attached "Proposed Schedule for the <br />CWCB Appropriation of Gunnison ISF" and affirm that Rules 5.51- 5.56 <br />(Procedural Rules for Contested ISF Appropriations) shall apply, with all <br />deadlines changed as set forth in the modified schedule. <br /> <br />The motion was approved 9-0. Carolyn McIntosh was not present. <br /> <br />A motion was made by Greg Hoskin and seconded by Keith Catlin to approve <br />the staff recommendation that the Board declare its intent to appropriate the <br />Gunnison River ISF water right based on the following: <br />. S This in stream flow appropriation is intended to implement the <br />settlement of the National Park Service Federal Reserved Rights <br />water rights application, preserve the unique natural environment of <br />the Black Canyon National Park and Gunnison Gorge and to not <br />contribute to flooding in the Delta area. <br />. S It is carefully structured to not interfere with the operation of <br />the Aspinall Unit of the Colorado River Storage Project, and to not <br />deprive the people of the State of Colorado of the beneficial use of <br />those waters available by law and interstate compact. <br />. S Consequently, this appropriation is based upon the facts and <br />circumstances particular to this situation and to this segment of <br />river, and shall have no precedential effect on future in stream flow <br />appropriations. <br />1. S Segment: USGS Gage #09128000 located just <br />downstream of the Gunnison Tunnel Diversion to the <br />confluence of the Gunnison River and the North Fork of the <br />
