<br />) <br /> <br />Agenda Item 51 <br />Case No. 5-97CW305; Vidler Water Company, Inc. <br /> <br />Ap.vlication Summary <br /> <br />This is an application for approval of plan for augmentation and exchange on the Blue River and Swan <br />River near Dillon in Summit County (see attached map). Applicant seeks the right to divert, and pump, <br />for domestic, commercial, and irrigation purposes a total of 150 consumptive acre-feet per year, at a rate <br />up to 4.5 cfs, with a priority date of October 25, 1988, from the "Upper Blue River Wells", "Swan River <br />Wells", and "Lower Blue River Wells". The application defines the Upper Blue River Wells as a series <br />of groundwater wells or infiltration galleries which divert water tributary to (1) the Blue River from its <br />headwaters downstream to the confluence with Dillon Reservoir, (2) Spruce Creek from its headwaters <br />downstream to the confluence with the Blue River, and (3) Monte Cristo Creek from its headwaters <br />downstream to its confluence with the Blue River. Similarly, the Swan River Wells are defined as a <br />series of wells ortnfiltration galleries diverting from the South Fork Swan River, Middle Fork Swan <br />River, North Fork Swan River, and Swan River. The Lower Blue River Wells are those points of <br />diversion located on the Blue River between Dillon Reservoir and Green Mountain Reservoir. <br /> <br />Applicant claims that its Memorandum of Agreement with the CWCB, dated October 25, 1988, gives it <br />the right to exchange water and to augment diversions in the Blue River basin without injury to the <br />decreed instre3m flows of streams and rivers located in Summit County. Applicant indicates that the <br />subject plan for augmentation and exchange will com.ply with all applicable terms of the instream flow <br />agreement. <br /> <br />) CWCB AJl.vro.vriations <br /> <br />The Board has instream flow water rights throughout the Blue River and Swan River basins which could <br />be injured by this application. <br /> <br />Potential for Iniury <br /> <br />Applicant's proposed plan for augmentation and exchange may deplete the Board's Blue River and <br />Swan River instream flow water rights if the terms and conditions of the above-referenced <br />Memorandum of Agreement are not strictly administered. <br /> <br />Other Obiectors <br /> <br />At the time this memo was prepared, the period for filing Statements of Opposition to this application <br />had not yet expired. <br /> <br />A:\597CW305.MEM <br />
