RE: DESIGN AND CONSTRUCTION OF WHITEWATER PARKS

Dear Mr. Kowalski:

At the June 10, 2005 meeting, the Board of Licensure for Professional Engineers and Professional land
Surveyors reviewed your May 19, 2005 letter requesting the Board's opinion with regard to the design and
construction of whitewater parks,

Upon review, it was the consensus of the Board to respond to your questions as follows.

1, Whether the design of the structures that create certain whitewater features constitute "the practice of

Yes

2. Whether these documents should be sealed by an engineer;

Yes

3. Whether the "design" work that has been done in certain instances is substandard;

Based on its brief review of the documents submitted, the Board believed that they appear to be
substandard.

4. Whether courses designed and built by non-engineers would be considered the illegal practice of
engineering.

Yes, courses designed by non-engineers would be considered the illegal practice of engineering,
but not the construction of such facilities.
