<br />37-60-104. Personnel. (1) The board shall consist of filleefl SIXTEEN members. The executive director of the <br /> <br />department of natural resources shall be a voting member ex officio. The attorney general, state engineer, director Of~ <br /> <br /> <br />division of wildlife, commissioner of agriculture or designee, and director of said board shall be nonvoting members 1P <br /> <br />officio. The nffie TEN remaining members shall be qualified electors of the state, well versed in water matters, and shall be <br /> <br />appointed by the governor, with the consent of the senate, for terms of three years; except that no appointment shall be made <br /> <br />that does not conform to the requirements of subsections (3) and (4) of this section. The appointments shall be made in such <br /> <br />a manner that the terms of three members shall expire on February 12 of each year; EXCEPT THAT EVERY TIlIRD YEAR, TIlE <br /> <br />TERMS OF FOUR MEMBERS SHALL EXPIRE ON FEBRUARY 12. In case a vacancy occurs in the appointed membership of the <br /> <br />board by death or resignation, the governor shall appoint a successor to serve the unexpired term of any member of the board <br /> <br />within thirty days after the creation of such vacancy. <br /> <br />(2) The appointed members of said board shall be chosen geographically as follows: Four from the western slope <br /> <br />and ffi<e SIX from the eastern slope; but, of the ffi<e SIX members to be appointed from the eastern slope, one shall be from <br /> <br />the Rio Grande drainage basin, one from the North Platte drainage basin, one from the Arkansas drainage basin, one from <br /> <br />the South Platte drainage basin outside of the city and county of Denver, ONE FROM THE SOUTH PLATTE DRAINAGE BASIN <br />ABOVE TIlE HENDERSON GAUGE, and one from the city and county of Denver and intimately familiar with its wa. <br />problems; and that of the four members to be appointed fnim the western slope, one shall be from the Yampa-White <br /> <br />drainage basin, one from the main Colorado drainage basin, one from the Gunnison-Uncompahgre drainage basin, and one <br /> <br />from the San Miguel-Dolores-San Juan drainage basins. Before entering upon the discharge ofltie A MEMBER'S duties, each <br /> <br />appointed member shall make, subscribe, and file with the secretary of state the oath prescribed by the constitution. <br />SECTION 20 Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the <br /> <br />ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition <br /> <br />pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or <br /> <br /> <br />an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall <br /> <br />take effect on the date of the official declaration of the vote thereon by proclamation of the governor. <br /> <br />. <br /> <br />-2- <br /> <br />SJ <br />
