<br />-2- <br /> <br />The main concern with this current process is that full disclosure of all of the factual <br />information, including water availability, for a proposed recommendation is not always available <br />until the January Board meeting. This is the same meeting at which the Board is asked to form <br />its intent to appropriate. Although the ISF Rules allow for public comment on the January <br />appropriations at the March Board meeting, formal notices to contest are due by March 31. This <br />condensed timeline frequently requires concerned individuals to formally contest an <br />appropriation in order to allow sufficient time to resolve concerns. (See Attachment A, "Existing <br />New Appropriation Processing Timeline). <br /> <br />As requested by the Subcommittee, staff has modified the existing timeline in order to <br />allow additional time for public notice and comment, and to allow an opportunity to resolve <br />concerns prior to the tiling of a notice to contest. The new timeline (Attachment B, "Proposed <br />New Appropriation Processing Time1ine") requires that an entity submit its formal <br />recommendation in writing with specificitv at the February workshop in order for it to be <br />considered for appropriation the following January, This change to the timeline tor processing <br />recommendations will not affect the Board's administrative process for appropriating ISF water <br />rights. <br /> <br />The table below describes the general procedure for the new proposed timeline. <br /> <br />Date Procedure <br />February 2006 Recommendations are submitted to Board or staff, in writing with <br /> specificity, no later than the date of the February workshop in order to <br /> be considered for appropriation the following January. At a minimum, <br /> the recommendations must include the following: <br /> . Stream name, location and the upper and lower termini of the <br /> proposed ISF reach. <br /> . Documentation of the existence of a natural environment (i.e., <br /> fishery surveyor other info.) <br /> . Quantification of the amount of water required to preserve the <br /> natural environment to a reasonable degree. <br /> . Hydrologic analyses which indicate that water is available for <br /> appropriation on the proposed stream reach <br /> . Specific information as to why the recommending entity has <br /> prioritized and recommended the stream or lake for protection <br /> under the ISF Program. <br />March 2006 A list of the stream reaches being recommended for appropriation are <br /> sent to the in stream flow subscription mailing list and are noticed at the <br /> March Board meeting <br />February 2006 to Staff analyzes the information provided by the recommending entities in <br />January 2007 order to provide the Board with accurate information to make the <br /> required findings as outlined in ISF Rule 5i. <br />March 2006 to Staff works with Board members and the public to identify concerns and <br />March 2007 develop solutions, <br />January 2007 Staff recommends that the Board form its intent to appropriate <br /> <br />Flood Protection.
