<br />I <br /> <br />I <br /> <br />numerous claims for water rights in the State of Colorado in both the <br />federal and state courts, seclcing to establish federal claims to much <br />of the water originating in Colorado, for the appointment of a federal <br />water master, and for other relief; and <br /> <br />Whereas, the federal government is claiming an unspecified and unknown <br />amount of water for such purposes; and <br /> <br />Hhereas, the granting of claims sought by the United Sta.tes could <br />seriously jeopardize the existing system of water rights within the <br />State of Colorado, could create a dual system of administration and <br />decrees, could require water users needlessly to re-adjudicate rights <br />already acquired and decreed under state law, could adversely affect <br />Colorado's rights under the Colorado River Compact and the Upper Colo- <br />rado River Basin Compact, and will cast an almost impossible burden <br />upon the citizens of this state in attempting to protect their indi- <br />vidual water rights; <br /> <br />Now, Therefore, Be It Resolved by the Colorado Water Conservation Board <br />in regular session assembled at Denver, Colorado, this 18th day of <br />January, 1973, that .the Board does hereby recommend to ::he Governor <br />of the State of Colorado, :0 the A:torney General of the State of <br />Colorado, and to the membzrs of :he Colorado General Assembly that all <br />steps necessary and proper, including appropriate funding, be taken <br />and authorized to require the United States to quantify its claims <br />and to adjudicate them and thereafter administer them in accordance <br />with state law; and <br /> <br />Be It Further Resolved that the Secrecary of this Board is hereby <br />direc-ted to furnish a true and correct certified copy of this resolu- <br />tion to the Governor and Attorney General of the State of Colorado, <br />and CO each of the members of the Colorado General Assembly." <br /> <br />Is .there any discussion on .the resolution? All .those in favor of .the <br />resolution signify by saying "aye" - opposed "no." It is ordered to <br />have passed. (See Appendix C). <br /> <br />Now I did something that I told everybody I didn't like. I brought a <br />resolution of my own and which I haven't shown to anybody. But every <br />member of the board now has it in front of him and I will read that <br />now. I have this resolution because I think that I would like to have <br />Larry have some support and authority to move quickly without the <br />board being in session and I think this may be required from time to <br />time.
