Stapleton: How do you expect to get a determination that quickly <br />on the matter? <br /> <br />Mr. Saunders: I think this won't be any problem at all. There is <br />a real good place in the state, I see a nominee is right over there, <br />sli~~ as a whistle, he has been admitted to practice law and he has <br />sometimes appeared in court, but he hasn't put on a witness yet and <br />I would like to see him do it, his name is Tam Scott. And some of us <br />will get on the other side right quickly. Realizing the importance of <br />the matter, I am sure the Supreme Court would expedite it and give us <br />a decision. <br /> <br />~tr. Stapleton: Before we ask for the director to comment, I would <br />like to introduce two people that ought to have a say and will have a <br />say in what we do here. Senator Noble, glad to have you with us. <br />Representative Baer, nice to have you with us. What we are doing is <br />trying to be helpful in terms of the Governor's request for a consti- <br />tutional amendment, as I think you both know. We have here for con- <br />sideration a proposed constitutional amendment. Up until last night, <br />I thought all the water people agreed to this amendment. I didn't <br />really believe it, but that is the report I had. Now this morning <br />we have heard a recommendation from a group of very distinguished <br />water lawyers that we ought to take a statutory approach first and <br />try that out. If it doesn't work. then we can go to a constitutional <br />amendment at presumably the short session next year. That is a pretty <br />cursory statement, cut Senator Noble, would you like to say anything? <br /> <br />Senator Noble: No, I came to listen. <br /> <br />Mr. Stapleton: Representative Baer, I am sure has a comment. <br /> <br />Rep. Baer: I am going to listen too. When you go to changing water <br />laws and constitution, it always scares me. <br /> <br />Mr. Stapleton: We are now going to ask Larry to respond to the sug- <br />gestions of the committee. <br /> <br />Mr. Sparks: I am very gratified, Glenn, that you started out in that <br />meeting supporting my position.
