This involves no intent of any <br />present right to change point of diversion, character of use, or <br />place of use. This is purely prospective and permits an appropriation <br />for these purposes. Now, we tried something like this years ago. <br />Cleland Feast is here and he will remember this. Two of us came <br />before the Fish and Game Commission at least twenty-five or thirty <br />years ago, I don't know how long Cleland, you were the director at <br />that time. <br /> <br />I <br /> <br />Hr. Feast: Thirty years ago. <br /> <br />Mr. 'Saunders: Thirty years ago. And tried to get the Fish and Game <br />to make appropriations for fish flows. They couldn't get anywhere. <br />Cleland quit them and went to work as a civil engineer because he just <br />couldn't seem to put over these aggressive ideas that he had. And <br />he wa~ very strong with this at the time, but he couldn't get the <br />job done. <br /> <br />But if we do this as of today, we impair no one's rights because these <br />rights are initiated as of now, 1973, 1974. At the last legislature <br />ample power was given to this board to make appropriations for all <br />purnoses fo~ state agencies. In addition to this change, there is <br />a part that we made another change where it provided "diversion" or <br />"divert". This is the correct clause, "means removing water from its <br />natural course or location, or controlling water in its natural course <br />or location." I would put a period right there. By the time you get <br />something done on this - the rest of this paragraph is adequate now <br />which says is going to be "by means of a ditch, canal, flume, reser- <br />voir, bypass, pipeline, conduit, well, pump, or other structure or <br />device." Now just think those words out. We then make "diversion' <br />not requiring a physical removal but simply controlling water in its <br />natural course or location. Now, this group thought that we should <br />make a real effort to have something like this done in the present <br />legislature instead of a constitutional amendment. In the first place, <br />it may be very difficult to get the two-thirds in each House neces- <br />sary to get a constitutional amendment for the people. And further, <br />if this could be done by such an amendment to our existing law as <br />these lawyers approved it last night, the constitutional amendment I <br />would be unnecessary and Ne would find out rather soon because this <br />board has the authority and power to make these appropriations. The <br />director of natural resources would then have direction of the thing. <br /> <br />I started out with a sort of given idea, I thought we had to have a <br /> <br />-29- <br />
