ADDENDUM TO CONTRACT OF APRIL 3, 1979

THIS ADDENDUM made and entered into this 24th day of

October I 1980, by and between the State of Colorado' for the

use and benefit of the Department of Natural Resources (Divi-

,sian of Parks and outdoor Recreation and Colorado Water

Conservation Board) hereinafter referred to as the "'state, 11

and the City and County of Denver, acting by and through

its Board of Water Commission'9rs', a municipal corporation

of the state of Colorado hereinafter referred to as the

"Contractor, II

WHEREAS, the State and the Contractor did on April

3, 1979 ,enter into an agreement ~hich provided, inter alia,

that the state would convey to the Contractor certain water

and ~ontract'rights then owned by it; and
WHEREAS, the certificates of ownership of those certain

water and contract rights have been misplaced and they cannot

now be located; and

WHEREAS, the Contractor will accept ~.Special Warranty

peed conveying the state's interest in those certain wa~~r and

contract rights to it, so that the state need not obtain a

Lost Instrument bond to protect ~he issuer of the certificates
of ownership; and
WHE~AS, those water and contract rights were later

determined to be more accurately described as is hereinafter

provided i .and

WHEREAS, the State desires to convey all of its interest

and entitlement in and. to the water, contract rights; and

water rights as are hereinafter set forth to the Contrac-

tor.

NOW, THEREFORE, in consideration of the respective

promises and agreements hereinafter set forth, the state

and the Cqntractor agree as follows:

1. Paragraph 2b .on page 6 of the Contract, dated

April 3, 1979, ?etween the state and the Contractor is amended
to read as follows:
