Platte River in the State of Colorado except for the

possible construction of the Perkins County Canal or the

South Divide Canal which has never been constructed.

It seems to me if the Fish and Wildlife is allowed to

prevail their stand, they've in essence negated that

interstate compact approved by two state legislatures, and

that's possible. And as to the applicability statewide,

I think all all seven interstate compacts are subject to

the same kind of attack to whatever whim some biologist

may come up with in southern California in terms of

protecting some habitat somewhere. I think that's a

strong threat to the interstate compacts.

Secondly, I think perhaps the Board needs to know a

little bit more background than the physical situation.

Riverside Irrigation District in conjunction with Public

Service Company of Colorado, two private entities. No

federal funding involved whatsoever in construction of the

Wildcat Reservoir.

It's an off-channel reservoir, proposed to construct it

basically for supplemental irrigation water as well as

cooling water to the pond and power plant. The site is

approximately ten miles from the South Platte River. It's

on a dry stream.

And it seems to me we want to look closely at what

Section 404 in the water act really requires or permits the
