Let me make two points very, very clear. First of all, <br />that would only be done if we are totally defeated in an effort to <br />utilize the water in the manner which we have declared we intend to <br />use it. And second, may I just call your attention to a little bit <br />of history? In 1961, the counsel for the Colorado River Water Con- <br />servation District and the Rocky Mountain Power Company got together <br />and said, "We ought to work out this problem of any transmountain <br />diversions arid the development into your project." And they developed <br />a contract, the terms of which I would just like to read to you, one <br />paragraph, if I may. Now this is the company and the company named <br />the Rocky Mountain Power Company. <br /> <br />"The Company agrees that it will not sell, rent, lease, or make <br />available any water of the White River or the Colorado River or its <br />tributaries which may be impounded in any of its storage facilities <br />to any person or entity for use in exchange for, or replacement of <br />water to be exported beyond the natural basin of the Colorado River, <br />provided that the Company may contract with the City of Colorado <br />Springs and its suburban areas to purchase, rent or lease, not to <br />exceed 1,500 acre-feet of water in anyone calendar year to be used <br />by that city." <br /> <br />That was approved by Rocky Mountain Power Company and it was tendered <br />to the District. <br /> <br />And I read to you from a letter dated June 8, 1961, directed to <br />Mr. Charles Beise, Attorney at Law, Rocky Mountain Power Company, <br />Denver, Colorado. <br /> <br />"Dear Mr. Beise: <br /> <br />The Board of Directors of the Colorado River Water Conser~ation Dis- I <br />trict met in special session June 7, 1961, to consider a draft of <br />agreement between the Rocky Mountain Power Company and the Colorado <br />River Water Conservation District as prepared by you and Mr. John D. <br />Barnard, Sr. in the offices of Barnard and Barnard at Granby, Colo- <br />rado, on May 3l, 1961. After due consideration, the board passed <br />the following resolution: Be it resolved that the Board of Directors <br />for the Colorado River Water Conservation District consider it in- <br />advisable to enter into any proposed agreement with Rocky Mountain <br /> <br />-l2- <br />
