Applicants identify a reach of Four Elk <br />Creek (1240 through 1927 feet from the west section line) and seek a surface water right "To allow <br />water to flow throughout property to public pond, fire protection and recreation to subdivision <br />owner." Applicants do not specify the amount they are requesting but indicate their appropriation <br />date as ''pre-1967.'' <br /> <br />CWCB Appropriations <br /> <br />No ISF right will be impacted by this application. <br /> <br />Potential for Injury: <br /> <br />The Applicant's claimed instream use of water appears to conflict with the Board's exclusive <br />authority to appropriate instream flow and natural lake level water rights. Section 37-92-102(3) <br />c.R.S. provides: ".. .no other person or entity [other than the CWCB] shall be granted a decree <br />adjudicating a right to water or interests in water for instream flows in a stream channel between <br />specific points, . . . for any purpose whatsoever." The Applicant may not obtain a decree that <br />violates this statuto!)' requirement. <br /> <br />Other Objectors <br /> <br />The other objectors in this case are the 4 Elk Property Owners Association, Ralph M. Ford, <br />Judith A. Ford and the Ralph M. Ford Trust, W.R. "Cy" Cobb and Brinda S. Cobb, and Robert E. <br />Spielman, Sheila J. Spielman, and the Sheila J.
