Instream Flow Program - Statement of Opposition - Roscoe Development Corp. <br />Tape I, Start/Stop: 4062 - 4114 <br />Action: A motion was made by Janice Sheftel that the Board ratify this statement of <br />opposition. The motion was seconded by Allen Davey and approved <br />unanimously (10-0). <br /> <br />9a. Instream Flow Program - Final Notice - Water Division 5; Brush Creek, Eagle and <br />Garfield Counties <br />Tape I, Start/Stop: 4114 - 4565 <br />Action: A motion was made by Patricia Wells that the Board accept the staff <br />recommendation and I) make the determinations pursuant to section 37-92- <br />102(3), C.RS.; 2) appropriate the recommended instream flows as presented <br />in the final notice dated August 20, 1997; and 3) direct the Attorney <br />General's Office to file the necessary water rights applications. The motion <br />was seconded by Janice Sheftel and approved unanimously (10-0). <br /> <br />lOa. Instream Flow Program - Consideration of Request to Inundate - Matheson Ranch <br />Tape I, Start/Stop: 4592 - 6280 <br />Tape 2, Start/Stop: 0001 - 0267 <br />Action: A motion was made by Janice Sheftel that the Board accept the staff <br />recommendation and approve the request to inundate, subject to the <br />applicants agreement to abide by the terms and conditions set out by the <br />Division of Wildlife in dealing with stocking issues.. The motion was <br />seconded by David Smith. After much discussion on various aspects of the <br />request, and the fact that the requester was not present to answer Board <br />questions, a substitute motion was made by Elizabeth Rieke that this item be <br />tabled until the November meeting so that the staff can get answers to the <br />Board's questions on issues regarding fishing, stocking, and use of the <br />facility.
