CO 80203 <br /> <br />Re: ~otice to Contest Arkansas (nstream Flow Appropriation <br /> <br />Dear Mr. Kuharich: <br /> <br />Pursuant to Rule 5K of the Rules Concerning the Colorado Instream Flow and Natural <br /> <br />'. <br /> <br />Lake level Program of the Colorado Water Conservation Board (eWCB). the City of Colorado <br /> <br />Spnngs, Colorado. acting through Colorado Springs Utilities (the Utlhties), hereby submits this <br /> <br />notice 10 conteslthe Arkansas River (nstream Flow (IS F) appropriation located from the fish <br /> <br />hatchery below Pueblo Dam downstream 10 the confluence of the Arkansas River with Fountain <br /> <br />Creek. The Utilities docs not oppose the proposed appropriation except to the extent that It may <br /> <br />be adnllnistered In a manner inconsistent with the Arkansas River Flow Management Program. <br /> <br />If the ISF is admmistered consistent with the Arkansas River Flow Management Program. then <br /> <br />the UtilIties will remain fully supportive ofeWCB's action. <br /> <br />In order to aVOid duplIcatlllg the comments of the Pueblo Board of Water Works. the <br /> <br />UlIhties Wishes to adopt those comments to the extent thai they refer to the various <br /> <br />intergovernmental agreements affecting this reach of the Arkansas River and prOVide for a flow <br /> <br />management program (the Flow Management Program). <br /> <br />. <br />
