<br />Agenda Item 9 <br />January 22-23, 2003 Board Meeting <br />Page 2 <br /> <br />Discussion <br /> <br />This water right donation is an integral component of an effort by the Animas River Stakeholders <br />Group to improve water quality and aquatic habitat iil the Animas watershed, and the water right <br />purchase was funded with a remediation grant under the State's Non-Point Source (319) Program. <br />Through this donation, the Council wishes to "elimitJ.ate the source of acid mine drainage and to <br />restore the natural hydrological regime" in the subject streams. It has been approximately 16 months <br />since the water rights were conveyed to the Board, and all parties are anxious to move forward with <br />the change. <br /> <br />The Board has already accepted this water right donatibn and holds the deeds for ISF purposes. Staff <br />is now preparing to file the change of water rigb;t application. Since the preliminary water <br />availability analysis indicates there may ]:>e water available that could be used to improve the natural <br />environment under SB02-l56, Staff could also include that use in the change application. <br /> <br />Staff Recommendation <br /> <br />e <br /> <br /> <br />Staff recommends that the Board approve the attached amendment to the Carbon Lakes Ditch <br />Donation Agreement to allow the acquired rights to be used to preserve or improve the natural a <br />environment in the subject stream segments. . ,. <br /> <br />Attachments <br /> <br />Flood Protection.
