<br />Action: <br /> <br />A motion was made by Keith Catlin. and seconded by Don Schwindt to approve <br />staffs recommendation with regard to the instream now tahulations for Escalante <br />Creek and that the Board: <br />(I) Determine. pursuant to section 37-92.102(3). CRS. and based upon the <br />recommendations of the BLM. a review of the data and other mformation <br />presented by Stafr. that: <br /> <br />a) A natural environment does e:'liSI on each stream; <br />(h) \Vater is available in each stream and lake for appropriation: <br />(c) The natural environment will be presl.:rved to a reasonable degree by <br />the water available for the recommended appropriations: <br />(d) There is a natural environment that can be preserved to a reasonable <br />dq,'Tee with the recommended water nghts. if granted: and <br />(e) Such natural environment can exist \vithout matenal injury to water <br />rights. <br /> <br />(2) And pursuant 10 Rule 51: establish January 25. 2005 as the appropnation date <br />for these insln:am tlows "'"ater rights. <br />(3) And request the Attorney General's Olliee to file the necessary water rights <br />applications. <br /> <br />The motion was approved (8-1).
