Action: A motion was made by Keith Catlin. and seconded by Don Schwindt to approve staffs recommendation with regard to the instream now tahulations for Escalante Creek and that the Board: (I) Determine. pursuant to section 37-92.102(3). CRS. and based upon the recommendations of the BLM. a review of the data and other mformation presented by Stafr. that: a) A natural environment does e:'liSI on each stream; (h) \Vater is available in each stream and lake for appropriation: (c) The natural environment will be presl.:rved to a reasonable degree by the water available for the recommended appropriations: (d) There is a natural environment that can be preserved to a reasonable dq,'Tee with the recommended water nghts. if granted: and (e) Such natural environment can exist \vithout matenal injury to water rights. (2) And pursuant 10 Rule 51: establish January 25. 2005 as the appropnation date for these insln:am tlows "'"ater rights. (3) And request the Attorney General's Olliee to file the necessary water rights applications. The motion was approved (8-1).
