<br />-2- <br /> <br />issues include the need for a ground water analysis to address delayed impacts to the Eagle River . <br />from diversions from up to 41 wells not yet constructed, and several other issues identified by the <br />Division Engineer. As of the date of this memo, the State and Division Engineers have notified the <br />Attorney General's Office that they are preparing a request for the Attorney General's Office to file <br />a motion to intervene in this case on behalf of the Engineers. <br /> <br />Staff Recommendation <br /> <br />Pursuant to ISF Rule 8j., Staff recommends that the Board authorize Staff to proceed to trial to <br />protect the Board's instream flow water rights on the Eagle River. Staff also recommends that the <br />Board discuss litigation strategy and potential settlement parameters with Staff and the Attorney <br />General's Office in executive session. <br /> <br />. <br /> <br />. <br /> <br />Flood Protection.
