recommendation was further reduced to 0.7 cfs for the time period of September Ie' through
January 31 e' based on limited water availability.

Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office
(DEO) to identifY any potential water availability problems. There are two decreed surface
diversions within this reach of stream (Bradbury and Helmke Ditches). According to the DEO,
downstream senior diversions should pull enough water through the proposed reach to satisfY the
recommended instream flow amount most of the time. Based on this analysis staff has
determined that water is available for appropriation on North East Creek, between the first
unnamed tributary downstream of King Reservoir and the confluence with East Creek, to
preserve the natural environment to a reasonable degree without limiting or foreclosing the
exercise of valid existing water rights.

CWCB Staff's Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:

Seament: unnamed tributary to East Creek
Upper Terminus: fust unnamed tributary downstream of King Reservoir
(Latitude 380 52' 58"N) (Longitude 108040' 19"W)
UTM ~ 4306 l40N 12701 944 E
SWNW S34 T13S RlOlW 6PM
1300' East of West Section Line 1990' South of North Section Line

Lower Terminus: confluence with East Creek
(Latitude 380 55' 06"N) (Longitude 108029' 55"W)
UTM ~ 43 10 49lN 127 16 874E
SW SE S18 T13S R99W 6PM
2600 ' West of East Section Line 780' North of South Section Line

Watershed: Lower Gunnison (HUC#: 14020005)
Counties: Mesa County
Length: 11.5 miles
USGS Quad(s): Glade Park, Snyder Flats, Jacks Canyon, Island Mesa, Whitewater
Flow Recommendation: 5.0 cfs (April 1 e' - June 30th)
1.0 cfs (July 1 e' - August 31 e')
0.7 cfs (September 1 e' - January 31 e')
1.0 cfs (February 1 e' - March 31 e')

- 5 -
