<br />. <br /> <br />. <br /> <br />. <br /> <br />11/2e/1998 15:37 <br /> <br />71952e9447 <br /> <br />MACDOUGALL LAW OFFIC <br /> <br />PAGE e4 <br /> <br />DISTRICT COURT, WATER DIVISION NO.3, COLORADO <br /> <br />Case No. 94CW62 <br /> <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND RULING OF THE REFEREE <br /> <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE SAN LUIS <br />VALLEY WATER CONSERVANCY DISTRICT, in Alamosa, Rio Grande, <br />Saguache, Hinsdale, and Mineral Counties, place of storage in <br />Mineral and Hinsdale Counties. <br /> <br />This matter came before, the Water Referee on the Amended <br />Application for Approval of Plan for Augmentation, Including <br />Exchange, and for Change of Water Rights, The Water Referee, <br />having made such investigations as are necessary to determine <br />whether the statements in the Amended Application are true and <br />being fully advised in this matter, hereby finds and concludes: <br /> <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br /> <br />1. Applicant filed its Application for Approval of Plan for <br />Augmentation, Including Exchange, and for Change of Water Rights <br />on December 30, 1994. On March 21, 1995 Applicant filed an <br />Amended Application to correct an error, <br /> <br />2. Timely and adequate notice of the application was <br />published as required by law and this Court has jurisdiction over <br />the subject matter of the proceeding and over all persons and <br />water rights affected thereby, whether they have appeared or not. <br />Republication of the amended application was not necessary. <br /> <br />3. The time for filing statements of opposition expired on <br />February 28, 1995. Timely statements of opposition were filed by <br />the State and Division Engineers and the Colorado Water <br />Conservation Board ("CWCB"), <br /> <br />4, Applicant is the San Luis Valley Water Conservancy <br />District ("District"), P.O. Box 729, Monte Vista, CO 81144, <br />(719) 852-2315. <br /> <br />5. Applicant is a statutorily governed water conservancy <br />district formed pursuant to the Colorado Water Conservancy Act, <br />C.R.S.
