<br />.l.'"%oJU <br /> <br />water of the Fryingpan River in adjudication <br />proceedings which were terminated by the <br />entry of a decree, I think in June, 1958. <br />Those proceedings have been reopened to the <br />extent of permitting the proponents of the <br />Fryingpan project to request a decree for <br />that project from the District Court. Hear- <br />ing on that matter has been continued from <br />time to time until it is now definitely set <br />for the 25th of May. 'On the 25th of May, <br />gentlemen, we are either going to submit a <br />stipulation setting this thing or I am going <br />to try a lawsuit. As far as my mind is pre- <br />sently geared I can see no further contin- <br />uances. Further, I doubt if his Honor would <br />look with favor upqn a further request for <br />continuance. . <br /> <br />Which brings us down to this, and it <br />is rather simple. It is just an accident of <br />circumstance that I happen to be the guy <br />who has to affix his name on the final act <br />in approving this thing. I'm not going to <br />do that until two things happen. One is <br />the introduction in the Congress of a bill <br />authorizing the Fryingpan-Arkansas Project <br />according to the presently drafted operating <br />principles, as they may be amended and <br />altered and modified to reflect the agree- <br />ment between the parties. Second, I will not <br />sign that stipulation until this resolution <br />is passed. u Third, the Board, by unanimous <br />action (the Board of the Colorado River Water <br />Conservation District) took the position <br />that if the State of 801orado, through its <br />Water Conservation Board, will not now <br />establish a firm policy with regard to the <br />use of water in western Colorado in line <br />with this resolution, then as I think Judge <br />.Hughes put it, we'll row our canoe and they <br />can row theirs. <br /> <br />It is just that simple gentlemen, and <br />this is one thing on which our Board is <br />adamant at this time. I won't comment on <br />what I would do even if the Board directed <br />me to sign that stipulation.
