This memorandum and the attached contract have been e-mailed to representatives of
Reclamation, the Service, the Colorado River Water Conservation District, the Southeastern
Colorado Water Conservancy District, the Rue~i Water and Power Authority, Basalt Water
Conservancy District and certain Ruedi water contractors. I have requested that they either provide
written correspondence or appear and comment at the Board meeting. The interested parties are
generally satisfied with the proposed contract with: the exception of the shortage sharing provisions.
However, they recognize that the possibility of shortages between now and 2012 is very unlikely and
therefore have agreed not to oppose this contract in the interest of showing support for the recovery
program.

Recommendation

Staff recommends Board approval of the proposed contract with Reclamation and the Service
to deliver up to 10,825 AF of water from Ruedi Reservoir to benefit endangered fish species in the
IS-Mile Reach of the Colorado River.
