RESERVOIR DELIVERIES TBROUGH <br />THE YEAR 2012 <br /> <br />Dear Brian and Randy: <br /> <br />We are aware through discussions with Randy that the Fish and Wildlife Service, <br />through George Smith, has indicated that it will not accept the proposal for sharing <br />shortages which we recently proposed and which Randy provided to the Federal <br />negotiating parties. As we understand the rationale for that decision, the Service believes <br />that the 2012 Agreement is a requirement for all of the Round II water sales. <br /> <br />We agree with that conclusion only in part. The initial Round II sales in the amount <br />of 6,135 acre feet are not specifically conditioned by completion of the 2012 Agreement, and <br />contracts for that water should be treated preferentially to the 2012 Agreement and the <br />balance of the Round II contracts in regards to shortages. <br /> <br />We had proposed a different shortage approach in the interest of compromise. <br />Because that concept is unacceptable to the Service, we must request that you provide in the <br />shortage provision that the 6,135 of issued and pending Round II contracts authQrized by <br />. the January 1999 Biological Opinion will not be subject to shortages shared with either the <br />
