Denver Water may use existing or future water rights and priority dates to fill, in <br />accordance with existing or future rights or during free river periods, the space in <br />its reservoirs vacated by the release of the 5,412.5 acre-feet of water. <br /> <br />3. To achieve the purposes of this agreement, Denver Water intends to store and <br />subsequently release water under its existing or future water rights in the amount <br />of 5412.5 acre-feet. It is Denver's responsibility to assure that all legal and <br />regulatory requirements are satisfied. <br /> <br />4. Denver Water will enter into separate agreements with other Eastern Slope water <br />users under which Denver Water will be reimbursed, on a pro-rated basis, for any <br />power revenues lost as a result of releasing the 5,412.5 acre-feet of water. <br /> <br />5 . To fulfill the terms of this Agreement, Denver Water shall not be required to <br />purchase or change any water rights. <br /> <br />6. By February I of each year that this agreement is in place, Denver Water shall <br />provide the CWCB with an accounting of all releases made during the previous <br />calendar year. <br /> <br />2. Reliability of the 5,412.5 Acre-Feet During a Drought <br /> <br />1. Denver Waterreserves the right to reduce releases of the 5,412.5 acre-feet of water <br />contemplated by this Agreement whenever water use restrictions are applied to all <br />users within Denver Water's Combined Service Area. Water use restrictions <br />include voluntary restriction programs designed to reduce total (as opposed to <br />peak) water demand. The percentage by which releases are reduced below 5,412.5 <br />acre-feet will equal the target use reductions for various levels of drought as <br />described in Denver Water's July 1997 "Drought Response Plan." <br /> <br />3. Rights and Responsibilities of the Service <br /> <br />I. The Service agrees to accept delivery to the CWCB of the water resources <br />described herein and in the River District/Service Agreement for the purpose of <br />providing protection for flow augmentation of the IS-Mile Reach of the Colorado <br />River for the benefit of the Recovery Program and the listed fishes, within the safe <br />and reasonable operation of the proposed sources, recognizing all existing prior <br />contract obligations. <br /> <br />2. The Service has generally described the arrangements contained in this Agreement <br />and the River District/Service Agreement in the PBO. Hence, water users which <br />sign Recovery Agreements will thereby agree not to oppose the use of Williams <br />
