Briefing Paper, Proposed Language and Supporting Material To Extend
The Authorized Periods for Appropriation and Implementation Within PL 106-392
May 2002

Page 7

[To be added to the Committee report}

SECTION-BY-SECTION ANALYSIS

Section 1. PURPOSE

This section describes the intent of this legislation.

Section 2. AMENDMENTS TO EXISTING AUTHORIZATIONS

This section amends two distinct authorities provided by the Congress for the implementing
of capital projects associated with the Upper Colorado Recovery Program and the San Juan
Recovery Program, namely appropriation authorization to pay for those capital projects and
authority given to the Secretary of the Interior to implement the capital projects using the
authorized federal funding and contributed funding specified in PL 106-392. This section extends
to 2008 authority for the Secretary of the Interior to implement capital projects for the Upper
Colorado Recovery Program and the San Juan Recovery Program.

Under existing law (PL 106-392, which this legislation modifies), authority for the
Secretary to carry out activities associated with implementing the Recovery Programs' capital
projects will expire in fiscal year 2005 for the Upper Colorado Recovery Program and in fiscal year
2007 for the San Juan Recovery Program. That authority is extended tluough the end of fiscal year
2008 by this section. The appropriation authorization period is also lengthened; however, the total
costs of the capital projects undertaken for the two recovery implementation programs remains at
the same authorized level of $100,000,000 as specified in Section 3 of that Law. The capital
project implementation authorization period for the Upper Colorado Recovery Program is extended
from 2005 to 2008 and for the San Juan Recovery Program from 2007 to 2008.

[SUGGESTIONS FOR WORDING OF OTHER REPORT SECTIONS ARE NOT PROVIDED]
