The City is unable to send a representative to your March 22, 2006 meeting at
which the hearing on Chaffee County's RICD will be continued. However, the City wants to express
its support for the County' s Water Court claims, as limited by the settlement documents that the
County will present at your March 22 hearing.

Chaffee County has worked diligently to address the concerns of the City of Salida
and other water users in the Arkansas River basin. The result of that effort is a Memorandum of
Understanding (MOU), proposed decree and various settlement stipulations. The City believes that
the settlement reflected in those documents adequately addresses each of the five statutory criteria
set out in Senate Bill 216. Therefore, the City of Salida respectfully requests the Board to
recommend that the Water Court approve the settlement and enter a decree confirming the RICD
application of Chaffee County

Thank you for your consideration.

Yours truly,

J~1~~

for
MOSES, WITTEMYER, HARRISON
AND WOODRUFF, P.C.

Attorneys for the City of Salida

JRM:rlo
