<br />Agenda Item 6b <br />Case No. 7-98CW029; Steward and Gwaltney <br /> <br />Application Sl1Il1I!larv <br /> <br />This is an application for a change of water rights on Lightner Creek near Durango in La Plata <br />County (see attached map). Applicant proposes a new point of diversion for 4.75 cfs associated <br />with the Steward Ditch No.3 and 0.25 cfs associated with the Munshower Ditch. The Steward <br />Ditch No. 3 would be a downstream movement and the Munshower an upstream movement. <br />Applicant proposes to convey this water via pipeline to the Steward Ditch No. 2 to irrigate <br />approximately 170 acres. The lands to be irrigated are different from the historically irrigated <br />lands. ' <br /> <br />CWCS Aporooriations <br /> <br />The Board holds an instream flow right on Lightner Creek for 10 cfs in the Sununer and for 4 cfs in <br />the Winter with an appropriation date of July 30, 1976, which could be injured by this application. <br /> <br />Potential for Iniury <br /> <br />Applicant's proposed change in points of diversiOrl may deplete the Board'sinstream flow water <br />rights on Lightner Creek.
