<br />(9) <br /> <br />Case No. 5-02CW108; SLC-Laurence, LLC <br /> <br />e <br /> <br /> <br />The Board ratified the statement of opposition filed in this case at its July 2002 meeting. The <br />Board's main objective in filing a statement of oppositiojI in this case was to assure that the Applicant <br />replace its out-of-priority depletions in time, place, and $ount, when the CWCB's instream flow water <br />rights were not being satisfied. The Staff, in cooperation with the Attorney General's Office, has <br />negotiated a settlement that fully protects the Board's instr~am flow water rights. <br /> <br />The Board holds the following instream flow rights, which could have been injured by this <br />application: <br /> <br />Case No. <br />5-85CW626 <br />5-97CW273 <br /> <br />Stream <br />Cattle Creek <br />Cattle Creek <br /> <br />Amount (cts) <br />4 ' <br />2 <br /> <br />Appropriation Date <br />11/8/1985 <br />9/22/1997 <br /> <br />The Applicant has agreed to the following terms and conditions that are fully protective of the <br />CWCB's instream flow water rights: <br /> <br />. At times when the CWCB's instream flow wat~r right on Cattle Creek is not being satisfied, <br />Applicant will curtail its junior diversions ot provide water in an amount equal to the <br />depletions, in the same time and location where those depletions impact the river system. <br />. The Applicant also has agreed to install, maintaih, and monitor such measuring devices as may a <br />be required by the State and Division engineer to administer the terms of the decree. .. <br /> <br />(10) Case No.1-91CW98; City and County of Denver <br /> <br />The Board ratified the statement of opposition filed in this case at its March 1992 meeting. The <br />Board's main objective in filing a statement of oppositioh in this case was to prevent an expansion of <br />use associated with this change of water right applicatiop. The City and County of Denver granted the <br />Applicant's motion to dismiss this application. . <br /> <br />e <br />
