<br />Case No. <br />1-94CW250 <br /> <br />Stream <br />North Turkey Creek <br /> <br />Amount (cfs) <br />3/.75 . <br /> <br />Appropriation Date <br />11/3/1994 <br /> <br />The Applicant has agreed to the following terms IUld conditions that are fully protective of the <br />CWCB's instreamflow water rights: <br /> <br />. At times when the CWCB's instream flow water right on North Turkey Creek is not being <br />satisfied, Applicant will curtail its junior diversions or provide water in an amount equal to the <br />depletions, in the same time and location where those depletions impact the river system, unless <br />it is de minimis pursuant to the earlier negoti~ted agreement between the CWCB and the <br />Mountain Mutual Reservoir Company._ <br />. The Applicant also has agreed to install, maintai~, and monitor such measuring devices as may <br />be required by the State and Division engineer to administer the terms of the decree. <br /> <br />(6) Case No. 5-99CW196; Ion at the Fairways <br /> <br />e <br /> <br /> <br />The Board ratified the statement of opposition filed in this case at its January 2000 meeting. The <br />Board's main objective in filing a statement of oppositioh in this case was to assure that the Applicant <br />replaced its depletions in the same time, place, and amo\Jnt at which they occur and to assure that any <br />diversion of water rights at upstream points of diversion ~ould only occur when the CWCB's intervening <br />instream flow water rights were satisfied. The Staff, in cooperation with the Attorney General's Office, .- <br />has negotiated a settlement that fully protects the Board's instream flow water rights. ., <br /> <br />The Board holds the following instream flow watbr right, which could have been injured by this <br />application: . <br /> <br />Case No. <br />5-86CW217 <br /> <br />Stream <br />Blue River <br /> <br />Amount (cfs) <br />32/16 . <br /> <br />Appropriation Date <br />3/14/1986 <br /> <br />The Applicant has agreed to the following terms' and conditions that are fully protective of the <br />CWCB's instream flow water right: <br /> <br />. The Applicant has agreed that at times when the ~WCB' instream flow water right is not being <br />satisfied, the Applicant will release to the stream :at or upstream of the wells an amount of water <br />sufficient to replace the gross depletions, less the!historic use credits from the subject wells. <br />. The Division Engineer shall administer the mo\(ement of water involved in the augmentation <br />plan. <br />. The Applicant also has agreed to install, maintaiiI, and monitor such measuring devices as may <br />be required by the State and Division engineer to, administer the terms of the decree. <br />, <br /> <br />(7) Case No. 5-01CW55; LGB Group, LLC <br /> <br />The Board ratified the statement of opposition filed in this case at its July 2001 meeting.
